TERMS & CONDITIONS


Liability for Delays


The carrier will not be liable for any delays that are a direct result of Bad Road Conditions, Inclement Weather, Accidents, Breakdowns, or other conditions that are beyond control of the carrier. Except in the case of willful misconduct or gross negligence of company, its agents or employees, customer hereby waives any and all claims against company, its agents or employees for injury, loss, or damage, including consequential damages, to customers person or property from whatever cause. In addition, customer waives any right of subrogation with regard to the same. Customer understands and accepts that Acts of God, unforeseen traffic and severe weather conditions delay travel. There may be unexpected vehicle breakdowns and other unforeseen events beyond the control of company, for which company shall not be liable to customer. There shall be no recourse for any of the same. In the event of a vehicle breakdown, all efforts will be made to supply a replacement vehicle. If a replacement vehicle is sent &/or customer refuses a replacement vehicle, no refund is due. If no replacement vehicle is available, refund shall be limited to the amount paid by customer. In case of an emergency, the company may sub contract his rental to another limousine/bus service. Capital Travels Bus Charter is not responsible to fulfill itineraries developed by the customer, which indicate a time that the customer expects to arrive at certain locations after the initial pick up time.

Non-Smoking


All vehicles owned and/or operated by CAPITAL TRAVELS BUS CHARTER, INC are designated as non-smoking.

Drug Use


CAPITAL TRAVELS BUS CHARTER, INC reserves the right to immediately terminate the job, for all parties in attendance for the use of an illegal substance (s) and/or any illegal activity by any guest in attendance. There will be no refund of any money to the client, due to the negligent behavior of the passengers.

Alcohol Use


No one under 21 is allowed in our vehicles with alcohol even if accompanied by anyone 21 years of age or older.

Property


CAPITAL TRAVELS BUS CHARTER, INC and its agents or employees shall not be liable for any personal property of the customer or customers’ guests, which are misplaced, damaged or left in the vehicle. Company reserves the right to institute and establish rules and regulations of guest conduct, which may be amended from time to time, including termination of rental, without refund, due to noncompliant guest conduct. Written additions and/or alterations by the customer, without written agreement of the company, are invalid and un-enforceable. The company reserves the right to sell and /or update any model of vehicle in its inventory. Specific vehicle requests are not guaranteed.

Damage to Equipment


The contracted party is responsible for any damage to seats, windows, or other equipment caused by vehicle passengers. The cost to the carrier for repairs to such damage will be charged to the contracted party. All vehicles are thoroughly cleaned and checked for damage prior to each engagement. The client shall be responsible for any cleaning or repairs which may be required due to any act of negligence or disregard by the client or by the client's guests. Additional charges will be applied to the credit card on file to cover any damages that occur; charges are as follows: Smoking in the vehicles $250.00 and immediate termination of the trip; Cigarette burns $500.00; Ripped or damaged upholstery $750.00 per burn, per tear, per incident of damage to leather in the Party Bus and or Hummer Stretch vehicle. Vandalism and Spillage of drinks $100.00; Damaged Carpet $250.00; Vomit in or on the vehicle $250.00; Lost or broken glass $15.00 per glass; Lost or broken remote $250.00; Excessive mess in the limousine $250.00. Chauffeur has the right to terminate the trip, without refund, if he/she feels that the party is not abiding by the above rules or is endangering other customers, himself and or others in the public putting the vehicle or the chauffeur at risk. Bottled beer is not permitted in the vehicle. Unless agreed in contract, canned beer only! All persons must be 18 years or older to enter this contract. Washington DC, Virginia, Maryland, Delaware, New Jersey, New York, North Carolina, Pennsylvania, South Carolina, Florida, and all others.

Equipment


The equipment that is furnished by the carrier is thoroughly inspected before being assigned to charter service to insure uninterrupted service. If for any reason beyond control of the carrier, a mechanical failure/breakdown makes it necessary to replace of a vehicle originally assigned to the service, the carrier will make every effort to replace the vehicle with one of a similar type or style. In no case shall the carrier be liable for consequential damages, or delays that are a direct result of mechanical failure or delay.

Arrival Time


The time of arrival at starting point, stop-over point, destination or return to point of origin cannot be guaranteed. Travel routes will be established by the Service Provider and requests for specific routes by the Contracted Party will be at the Service Providers discretion. Travel speed all times at speeds compatible with safe operation. Road, traffic and weather and no refunds shall be given as a result of late arrivals due to such conditions or other occurrences out of the control of The Company or the Service provider. Client understands any changes to the contract, once signed, will result in a price increase.

Travel Agents/Brokers


READ CAREFULLY: You will be billed for any additional service rendered your client. If service is NOT to be extended, the agent booking the service MUST indicate this on the front of the Sales Order prior to returning it to our office. To further insure cost control; please make a group leader responsible for signing, as well as indicating end-of-service time on driver’s manifests.

Pre-pay Customers


Any first time customers, or customers who have a pre-pay account with CAPITAL TRAVELS BUS CHARTER, INC, must provide payment in full, No later than 14 days prior to service. Payment may be made by check, major credit cards or money orders. Without complete payment, services will not be rendered.

In case of any disputes/charge backs from the clients, CAPITAL TRAVELS BUS CHARTER, INC reserve their rights to take legal actions against the customer/company and customer/company will be responsible for all the court fees, including reasonable attorney’s fees . Customer agrees to 50% non-refundable deposit, which is non-refundable and additional fee to the final costs of the service. The Capital Travels Bus Charter fee covers costs in fuel, administration, federal and state taxes and all operating costs associated with the transportation service provided. IT IS NON-REFUNDABLE. Management reserves the right to place a $250 and/or $500 deposit/service fee during a season to protect all parties from the above and below actions. The service fee and/or deposit is a minimum deposit $250.00 and not to exceed $500. Trip service fees part of the cost of service are non-disputable with regard to trip conditions that may be adverse and or are described above conditions stated above.

Cancellation Policy


Cancellations must be in writing and emailed to info@capitaltravelsbuscharter.com. Cancellation fee is 100% of the total rental price if not made within 30 days prior with the sales staff and/or dispatch operator.
